1. Who we are
Genesis Black is a trading name of Genesis Black Limited, a company registered in England and Wales (company number 17381514). Registered office: 43 Granville Street, Bristol, England, BS5 9SW. We are the controller of the personal information described in this policy. You can contact us about your information at procurement@genesisblack.co.uk.
2. Information we collect
- When you contact us: your name, email address, phone number, the business you work for, and what you tell us in your message.
- When you register for a trade account: names, job title, contact details, business details such as company and VAT numbers, business, billing and delivery addresses, delivery instructions, ordering preferences, how you heard about us, and your signature details.
- Proof of business and address: documents you send us to confirm your business, such as a Companies House certificate, a business bank letter or statement, or a recent utility or business rates bill. These may contain personal information.
- Orders and payments: order and invoice records, and the payment details we receive with your bank transfer (such as the name of the paying account).
- Claims: photographs, videos and correspondence you send us about a delivery.
- Our website: our website does not use cookies or analytics. Like most websites, our hosting provider keeps basic technical logs (such as IP address, browser type and the pages requested) for security and to keep the site running. The fonts on our website are loaded from Google Fonts, which means your browser connects to Google, who receive your IP address.
3. How we use your information and our legal basis
- To respond to your enquiries: our legitimate interest in running our business and replying to people who contact us.
- To assess your registration and open and manage your trade account: to take steps at your request before entering into a contract, and to perform our contract with you.
- To process, deliver and invoice your orders and handle any claims: to perform our contract with you.
- To verify your business and prevent fraud, for example by checking Companies House records, HMRC VAT number checks and the documents you provide, and by checking claims against our dispatch and delivery records: our legitimate interest in protecting our business and our customers from fraud.
- To keep accounting and tax records and meet other legal obligations: legal obligation.
- To send you updates about new products and categories: only where you have opted in, on the basis of your consent, which you can withdraw at any time.
4. Who we share it with
We only share information with organisations we need to run our business, such as delivery couriers, our bank, our accountants and professional advisers, insurers, and email, cloud storage and IT providers. They may only use it to provide their services to us. We may also share information with the police, HMRC or other authorities where the law requires it or to prevent or report fraud. We never sell your information.
5. Storage and transfers outside the UK
Some of our service providers, and people working for us, may access information from outside the UK. Where this happens, we take steps to make sure it remains protected to the standard required by UK law, for example by using providers in countries the UK recognises as adequate, or by putting approved contract terms in place.
6. How long we keep it
- Enquiries that do not lead to an account: up to 24 months.
- Declined registrations, including any documents sent: deleted within 12 months.
- Trade account information: while your account is active.
- Proof of business documents: while your account is active, and for up to 12 months after it closes, unless we need them for a claim or legal reason.
- Order, invoice and financial records: six years after the end of the financial year they relate to, to meet UK tax requirements.
- Marketing preferences: until you withdraw consent.
7. Keeping it secure
We use appropriate technical and organisational measures to protect your information, including access controls and secure, password-protected systems. Only people who need your information for their work can access it.
8. Your rights
Under UK data protection law you can ask to access, correct or delete your information, restrict or object to how it is used, receive a copy of it in a portable format, or withdraw consent at any time. To make a request, email procurement@genesisblack.co.uk. We will respond within one month. We do not make decisions about you using solely automated means.
If you are unhappy with how we have handled your information, please contact us first so we can try to put it right. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.
